The Seller’s Solicitors has been advised that the proprietor of a neighbouring property is claiming that they agreed to switch garages with the previous proprietor of the Lot 25 years ago. As such the neighbour is claiming possession of the garage within the title of the Lot. The neighbour further claims that the garage within title BK288547 is owned by the previous proprietor of the Lot. the Seller has not been provided with evidence of the claimed garage swap.
It has also been highlighted that the neighbour has installed a side door for access into the garage situated within the extent of the Lot. The neighbour has suggested that he would be agreeable to legally formalise the garage swap with an incoming purchaser.
The garage included in the Lot is therefore sold without vacant possession.
