A third party has contacted the seller seeking to claim an express right of way over Pembridge House (Lot 98) (“the Property”) by way of a deed of grant dated 14 March 1977 (contained within the auction pack). The third party has confirmed that the right claimed is along the same route as the known rights to which the Property is subject under the conveyance dated 1 June 1976 (contained within the auction pack). The deed is not registered on the seller’s title and was entered into between other parties after the transfer of the Property to the seller’s predecessors. Whilst the seller does not consider this deed of grant to be legally binding on the title to the Property, any party intending to bid must satisfy themselves in that regard.
